- You have a right to ask the DWP to look at their decision again within one
month. This is called a revision
- Request copies of the doctor's medical report / Decision Maker’s decision from the
DWP
- If you can’t read the doctor’s handwriting, you can ask for a typed copy
- Seek what supporting evidence you can from people who know you—e.g. doctor,
psychiatrist, CPN, keyworker, Centre worker, carer, friends
- Write to the DWP enclosing any supporting evidence and
specifically requesting revision.
- You also have a right to Appeal the decision within one month
- If you don’t already get it, claim Disability Living Allowance whilst waiting
for the Appeal to be heard. A successful claim will help to replace lost income
and restore entitlement to the Disability Premium within Income Support.
- Once you have appealed you may also be able to either claim Income Support (at
a reduced level) whilst waiting for your appeal or claim Jobseekers Allowance.
Claiming JSA can be very difficult when you are trying to cope with mental
health difficulties, but the fact that you have claimed it will not count
against you when your Appeal is heard.
- If you feel unable to attend a tribunal, you can ask for it to be held ‘on the
papers’ and either prepare a ‘statement of evidence’ yourself or with help. You
can also ask people to go with you or instead of you to speak on your behalf.
Statistically you have a better chance of winning your tribunal if you attend,
and an even better chance of winning if someone represents you.
- If there are any health problems the old claim didn’t address, or your health
gets significantly worse, you can apply again.
